These Terms of Service ("Terms") form a legally binding agreement between you and 73 Auto Ltd (company number 16883211, registered office 71-75 Shelton Street, London, England, WC2H 9JQ) governing your use of the 73auto.com Total Cost of Ownership service (the "Service"). By creating an account, purchasing a pack or subscribing to a plan, you confirm that you have read, understood and agree to be bound by these Terms.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to do so and that the entity will be bound by these Terms.
1. Service description
73auto.com calculates the Total Cost of Ownership of a UK road vehicle by combining live data from the DVLA Vehicle Enquiry API with our own depreciation, fuel, insurance and tax models. The Service is provided through the website 73auto.com and the underlying API. We continuously improve the underlying models and may add, change or remove features; we will not materially reduce the core functionality of any plan you have actively paid for without notice.
2. Accounts
To purchase a pack or a subscription you must create an account using a valid email address. You are responsible for keeping your credentials confidential and for everything that happens under your account. You must notify us at Info@73auto.com promptly if you suspect unauthorised use. You must be at least 18 years old to create an account. One person or legal entity per account; you may not share, sell or transfer your account without our written consent.
3. Pricing and billing
Current prices for all packs and subscription plans are listed on the Pricing page. Prices are quoted in pounds sterling and, where you are a UK consumer, are inclusive of VAT. Where you are a VAT-registered business outside the UK, applicable reverse-charge rules will be shown at checkout.
- Packs (one-off purchases) are charged once and grant the stated number of TCO checks to your account. Check credits do not expire.
- Subscriptions are charged monthly in advance to the payment method on file via Stripe. Each renewal grants the stated monthly check quota; unused checks within a billing month do not roll over.
- Business subscriptions carry a minimum six-month commitment that takes effect on first payment. By subscribing to a Business plan you agree to pay the full six monthly fees, regardless of any early cancellation request, unless we agree otherwise in writing.
Failed payments may result in temporary suspension of the Service until the balance is settled. We will give you at least 7 days' notice before any price change affects your account.
4. No refunds policy
All sales are final. No refunds are offered for packs once purchased, nor for any monthly subscription period that has begun.
The Service is supplied as digital content that is delivered immediately on purchase. By proceeding through checkout you give your express consent to immediate performance and you acknowledge that you waive your statutory right to a 14-day cancellation period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (regulation 37(1)(a)) for the digital content element of the Service.
This no-refund policy does not affect your statutory rights under the Consumer Rights Act 2015 where the Service is not provided with reasonable care and skill or is not as described. If you believe the Service is defective, contact Info@73auto.com and we will investigate; where we are at fault, we will provide a remedy (re-performance or, where appropriate, a refund) in accordance with the Act.
For business subscriptions, the no-refund rule applies in full and is not limited by consumer-protection law.
5. Acceptable use
You agree that you will not, and will not permit any third party to:
- use the Service to violate any law, infringe any third-party right or transmit any unlawful content;
- attempt to gain unauthorised access to the Service, other users' accounts, or supporting infrastructure;
- reverse-engineer, scrape, decompile or otherwise extract source code or non-public data, except to the extent permitted by mandatory law;
- resell, sublicense, white-label or otherwise commercially redistribute Service output without a separate written agreement;
- send automated requests that exceed your plan's quota, bypass rate limits, or otherwise burden the Service disproportionately;
- use the Service to make decisions that produce legal or similarly significant effects about a Data Subject without a separate human review;
- submit personal data of third parties (beyond a VRM) into the Service without a lawful basis to do so.
We may suspend or terminate access for material or persistent breach of this section, with notice where practical.
6. DVLA data disclaimer
Vehicle data shown by the Service originates from the DVLA Vehicle Enquiry API and other public sources. We pass DVLA responses through and add our own calculations, but we do not guarantee the completeness, accuracy or timeliness of upstream data. The Service is provided for informational purposes; it is not an MOT certificate, a vehicle history check, a finance check, a stolen-vehicle check or a substitute for professional inspection or advice. Always verify critical decisions (purchase, finance, insurance) with the original document holders.
7. Intellectual property
We retain all right, title and interest in and to the Service, the underlying models and the website. You are granted a non-exclusive, non-transferable, revocable licence to use the Service for the duration of your subscription or pack credits. Output you generate for your own vehicles is yours to keep and use for your internal purposes.
8. Limitation of liability
To the maximum extent permitted by law:
- We exclude all implied warranties, representations and conditions.
- We are not liable for any indirect, incidental, consequential, special or punitive damages, nor for loss of profit, revenue, business, anticipated savings, goodwill or data, however arising.
- Our total aggregate liability arising out of or in connection with the Service is limited to the amount you have paid us in the twelve months immediately preceding the event giving rise to the claim, or £100, whichever is greater.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under UK law.
9. Suspension and termination
You may close your account at any time from your profile page. We may suspend or terminate the Service for material breach of these Terms, for non-payment, or where required by law. On termination, your access to the Service ends, any unused pack credits are forfeited, and our retention and deletion obligations in the Privacy Policy apply.
10. Changes to the Terms
We may amend these Terms from time to time. For non-material changes, the updated version takes effect when posted. For material changes, we will give at least 14 days' notice by email to registered users; continued use of the Service after the notice period constitutes acceptance.
11. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except that consumers resident in Scotland or Northern Ireland may bring proceedings in their local courts where mandatory law so requires.
